User Agreement

This English text is the sole binding version of this document.

This User Agreement (“Terms”) is a contract between you and Ratomski Maksim, a natural person in Batumi, Georgia, operating the Spotbook service (“Spotbook”, “we”, “us”), for use of the Spotbook website, workspace, and related desktop software (together, the “Service”). By creating an account, signing in, installing Spotbook Screenshotter, or otherwise using the Service, you agree to these Terms and to the Privacy Policy. The Service is provided free of charge as an MVP. You accept the allocation of risk below; it is a fundamental basis of this contract.

1. The Service

Spotbook is a poker study workspace. It lets you store table and lobby captures, attach notes and solver output, organise spots, and discuss them with contacts, groups, or coaches. Spotbook is not a poker room, wallet, payment processor, or gambling operator. We do not take bets, settle results, or provide real-money play.

The Service includes the web application, optional Windows desktop capture software (Spotbook Screenshotter), Desktop Connect pairing, voice-to-text for notes, sharing, group and direct chats, a public Support space for signed-in users, and related APIs.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract. The Service is a study tool for adult poker players. If you use Spotbook on behalf of an organisation, you confirm that you have authority to bind that organisation.

3. Account and sign-in

Accounts are created through Google, Discord, or Telegram. Each provider identity is a separate Spotbook account; we do not merge providers. You are responsible for the security of the sign-in method you use and for activity on your account.

  • Choose a nickname and optional avatar during onboarding. Your nickname and avatar are visible to people you interact with (contacts, groups, chats, shares, Support).
  • Do not impersonate another person or use a nickname that infringes someone’s rights.
  • If you lose access to your Google, Discord, or Telegram account, we may be unable to restore the corresponding Spotbook account.
  • You may delete your account in Settings. Deletion is permanent and also deletes groups you own, your captures and solutions, your chat history in threads that cascade with your account, API tokens, and connected devices.

4. Desktop app, devices, and API tokens

Spotbook Screenshotter is optional Windows software that captures the table (and optionally lobby context) and can upload it to your workspace after a delay designed to respect typical poker-room rules. Pairing uses Desktop Connect: the desktop app starts a short-lived code, you approve it while signed in, and the app receives an API token (nvn_…). A limited number of devices can be connected at once.

We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to install and run the compiled desktop application in object-code form on devices you control, solely to use the Service. We do not sell the software. All rights not expressly granted stay with us. Screenshots and notes you create with the app remain User Content as described below. Source code, protocols, unpublished APIs, local databases, caches, replay buffers, logs, configuration, models, and other internals of the app are our data and our intellectual property, not yours.

  • Keep the desktop app and tokens under your control. Anyone with a valid token can upload to your account.
  • Revoke devices you no longer use in Settings → Connected devices.
  • Voice notes recorded in the desktop app may be sent to Spotbook for transcription and then, if you save them, stored as note text you created.
  • Local-only capture mode on your computer is outside Spotbook’s hosting; these Terms still apply to the software we provide.
  • Do not copy (except one backup), modify, adapt, translate, rent, lease, sublicense, sell, redistribute, or create derivative works of the desktop app.
  • Do not reverse engineer, decompile, disassemble, decrypt, unpack, or otherwise attempt to derive source code, algorithms, or file formats from the compiled application, except only to the extent a mandatory law (for example interoperability) gives you a non-waivable right after you have first asked us in writing for the information you need.
  • Do not scrape, harvest, extract, or reuse internal data from the desktop app (local stores, caches, replay buffer, logs, tokens, capture pipeline, or traffic to our APIs) except through the functions the app itself exposes for your own captures and notes.
  • Do not circumvent the upload delay, device pairing, token binding, licence checks, or other technical protections, and do not use the app or its protocols to build a competing capture or upload product.

5. Your content

You retain whatever rights you already have in content you upload or create (“User Content”): screenshots, lobby images, notes, hashtags, folders, solver archives (for example HRC .zip files), chat messages, reactions, attachments, avatars, group names and icons, and similar material.

You grant Spotbook a worldwide, non-exclusive licence to host, store, process, transmit, display, and make backup copies of User Content solely to operate, secure, and improve the Service and to provide the sharing and collaboration features you use. This licence ends when the content is deleted from our systems, except for copies retained for a limited time in backups, security logs, or as required by law.

  • You confirm that you have the right to upload User Content, including screenshots that may show other players’ nicknames, stack sizes, or table UI, and solver files that may be subject to a third-party licence.
  • Spotbook does not claim ownership of solver engines or of poker-room software. Uploading output does not grant you extra rights in those products.
  • Shared or group content remains visible to people you already granted access until you remove that access or the content is deleted.

6. Sharing, groups, and chats

You decide who sees a spot: keep it private, share with a contact, share into a group, or open a discussion attached to a hand. Group owners and roles you configure can manage membership, folders, and chat access. Direct messages and group messages are stored so that participants can read the history. Chat bodies are encrypted at rest with a key held by Spotbook so we can provide the product; this is not end-to-end encryption.

If you own a group and delete your account, that group and its catalogue are deleted for all members. Think before making yourself the sole owner of a group others rely on.

7. Acceptable use

You agree not to:

  • Break applicable law, including gambling, intellectual-property, privacy, or computer-misuse rules in your jurisdiction.
  • Use the Service to cheat, collude, or provide real-time assistance at a live or online table in a way that violates a poker room’s rules. The desktop delay is a safeguard, not permission to bypass those rules.
  • Upload malware, attempt unauthorised access, probe other accounts, scrape the Service, or overload our APIs.
  • Share another person’s captures, messages, or personal data without a lawful basis.
  • Post illegal, harassing, or clearly abusive content in chats, comments, Support, or group names.
  • Circumvent rate limits, token controls, or two-factor requirements for privileged staff accounts.
  • Decompile, reverse engineer, or extract internal data from the desktop application except as section 4 allows.

We may suspend or delete accounts, revoke devices, remove content, or refuse uploads that we reasonably believe violate these Terms or threaten the Service or other users.

8. Third-party services and poker rooms

Sign-in is provided by Google, Discord, or Telegram. Object storage, hosting, optional realtime delivery, and voice transcription are provided by our processors (described in the Privacy Policy). Solver software such as HRC is not part of Spotbook; you need your own licence to generate files you upload.

Poker rooms have their own terms. Capturing, storing, or sharing hand images may be restricted by a room. You are responsible for complying with those rules. Spotbook is not affiliated with any poker network.

9. Spotbook intellectual property

The Service, including the website, compiled desktop application, APIs, design, trademarks, and documentation, is owned by us or our licensors. These Terms licence use of the object code only; they do not transfer ownership. You may not copy, modify, distribute, resell, reverse engineer, decompile, disassemble, or extract data from the Service or the desktop app except as allowed in section 4, by a mandatory rule of law that cannot be waived, or by a separate written licence from us.

10. Availability, changes, and no professional advice

We provide the Service on an “as is” and “as available” basis, without any warranty of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, backup, support, or error-free operation. Features may change, break, or be withdrawn at any time without notice. Solver viewers, capture formats, and desktop behaviour can evolve. Spotbook does not warrant that a stored spot, simulation, or transcript is complete or correct, and it is not financial, legal, or poker coaching advice unless you separately hire a coach who uses the Service. We have no duty to monitor User Content or to keep copies for you.

11. Data, leaks, and no security warranty

You use the Service at your own risk. Do not store information you cannot afford to lose, leak, or disclose. We do not promise confidentiality, integrity, or availability of your data. Residual risk of unauthorised access, loss, corruption, misdelivery, or public exposure is accepted by you as a condition of using a free MVP.

  • To the fullest extent permitted by law, we are not responsible for data leaks, hacks, ransomware, misconfiguration, bugs, human error, failed backups, or unavailability.
  • We are not responsible for acts or incidents of processors and third parties (hosting, object storage, OAuth providers, OpenAI transcription, realtime delivery, your device, your network, poker rooms, or other users).
  • We are not responsible if you share a spot, leave a group open, leak an API token, lose a device, or if people you chat with copy or forward content.
  • Chat is not end-to-end encrypted. We can read message bodies when providing the Service. Do not treat Spotbook as a sealed messenger.
  • Screenshots may show other players. You are solely responsible for that content and for poker-room rules.

12. Requests from authorities

You agree that we may access, retain, copy, and disclose account data, User Content, logs, device records, and any other information we hold if we receive a request, order, inquiry, or legal process from a court, police, prosecutor, regulator, or other public authority of Georgia or of any other country, or from a private party with a court or similar order, or if we in good faith believe disclosure is required or permitted by any applicable law, is necessary to protect us, the Service, or others, or is needed to investigate abuse.

  • We may comply without asking you first and without telling you afterwards, unless a mandatory rule that cannot be waived requires notice.
  • We have no duty to challenge, appeal, delay, or minimise a request, or to verify it beyond what we in our sole discretion consider reasonable.
  • We are not liable to you for such access or disclosure or for any consequence of it, including in your country of residence.
  • If a request conflicts with another country’s law, we may still comply as we see fit. You waive claims arising from that choice to the fullest extent permitted.

13. Liability

To the fullest extent permitted by the law of Georgia, we (including the natural person operating Spotbook) have no liability to you for any claim arising out of the Service or these Terms, whether in contract, tort, statute, or otherwise. This includes direct and indirect loss, incidental, special, punitive, or consequential damages, lost profits, lost data, leaked data, lost access, reputational harm, poker-room sanctions, and claims by third parties.

If a court nevertheless finds that we have any liability that cannot be fully excluded, that liability is limited to the amount you actually paid us for the Service in the 12 months before the claim (zero while the Service is free). You agree this cap is a reasonable allocation of risk for a free MVP.

Nothing in these Terms excludes liability that applicable law does not allow to be excluded (in particular liability for intent or gross negligence where such an exclusion is forbidden). That is the only liability we accept beyond what the law forces. You release us from every other claim to the maximum extent you can.

14. Indemnity

You will defend, indemnify, and hold harmless Spotbook and the natural person operating it from claims, damages, fines, and reasonable legal costs arising from your User Content, your use or misuse of the Service, your sharing, your violation of poker-room or third-party rules, or your breach of these Terms, including claims by other players, groups, or authorities, except to the extent caused solely by our wilful misconduct.

15. Changes to these Terms

We may update these Terms by publishing a new version at this URL. The new version takes effect when published, or later if we state a later date. We may, but are not obliged to, mention a change in the product. Continued use after the effective date is acceptance. If you do not agree, stop using the Service and delete your account.

16. Governing law

These Terms are governed by the law of Georgia, excluding conflict-of-law rules. Courts of Georgia have exclusive jurisdiction. Mandatory rights that your local consumer law does not allow you to waive remain only to that unavoidable extent; they do not expand our duties beyond that minimum.
